Apples and Oranges. You can't contrast what was legal before the United States existed or what was not constitutional to standards adapted afterwards. Under the Constitution we have habeas corpus protection . This applies to anyone held by the US. And for what its worth the MCA passed last October is a menace to Americans as a whole. I am thinking and hopeful we will change it once we are rid of the Bush administration. If Bush can deem anyone liable to arrest with out due process, the safety and security of all Americans is compromised.
