They can regulate any business they want. In this case the regulations are designed in order to prevent the major oil companies from flooding the market with gas for sale at below cost, thus driving away the mom and pop businesses. In this case it caught a mom and pop business, but in general it protects them a lot more then it hurts them. Also don't think for one moment that if the law was changed that the oil companies would not consider driving the moms and pops stores out of business. They'd love nothing better since once the mom and pop stores where gone they could really jack the price up to a ton more then what it even costs now.

When citizens vote in representatives - they give the authority for laws pass for their benefit, Our country has a very poor voter turn out. We wind-up getting the cream of the crop that a minority of citizens chose. Perhaps what you cited is another example of apathy
