If you witness any type of accident, you have a moral if not legal obligation to notify authorities immediately, and render any aid possible. There can be no argument about this, without exposing the sickness of our society.

Good question I would say no. legally The case is against your friend. And they will question people of course.

I would think it would be the right thing to do to call police though when the evidence is best then to wait. However you would want to protect your self ,,, I mean in case this friend was to try and turn the case against you !!!

Reminds me of a rape movie, where a bystander in a bar had to testify in court,, They said even though he was a witness this did not make him a criminal as long as he did not partake in the rape or chant and motivate the actual criminals. Same as if it was a fatality.

Also if you turn in your friend or are determined to be a witness,, you will still need to tell the truth to best of knowledge or be held for possible perjury.

As much as I can think here.

It should be your legal and moral obligation to help out. Especially a fatality. The truth will be found, and when it is, and it's found that you were a witness, I think they could nail you big time for it. If and when a trial would come up, the apposing council could have you removed as a witness because you had been drinking.

Morally you should tell the police what you witnessed and what you know happened. They will investigate to see if it is valuable. It could be coincidence that the person your friend hit is dead and it could be more serious - just say what you know and leave the rest to law enforcement.

Morally you have an obligation..but the duty-to-rescue/report law is still in debate that would make it a criminal offense if a person fails to help in a situation as the one you describe.

Would you want someone to call the police, if it was someone you loved? You should put yourself in the place of other people, and how you would feel if no one called.

American bystander rule would suggest no, unless you have legal duty to the person you do not have to render aid. If you were in any involved in the accident or incident you created the peril and you would have to do something.
