I heard this news over the radio a man parked his car and slept in it. An officer walk over questioned him, the man answered he trying to sleep over the drunkness, i guess he went to a bar before that. Then the officer spot some open bottles and ask him to stand out. Is that illegal? To have open bottle but not driving the car.

In most states, both having an open alcohol container and sleeping your car while intoxicated are illegal and the man could be cited for a DUI/OWI for either.

As above poster had mentioned, he would not even have to be in the car if the keys were in the ignition and have seen many a case of this, as it showed intent to drive and could still be cited for DUI/OWI

You don't mention the state you live in - but in most states, it is against the law to have open bottles of alcohol in the car.

Sure is DUI/DWI in most states. Read the statute concerning it but as long as you have the ability to use your car you are in violation of the law if you are in it and intoxicated.
