During the sep. I got pregnant w/ my 3rd. I NEVER claimed it his & NEVER made him pay anything. We got together & 2 yrs later I found out & had him convicted for molesting our dghtr - he pled guilty as there was evidence. He served no time & for the past 3 yrs - works to pay a minimum of child support & medical coverage for all 3 children. I am heavily dependant upon that for income right now as I only work PT w/ no benefits & job prospects are not panning out very well. My family helps tremendously & God Bless them for that. He ate through what little savings I had when we reconcilled &left me with no other choice but to file bankruptcy. I need to do this very soon in order to try & save some money rather then continue to pay off his debt. Is it true that I need to divorce first then file bankruptcy - the second I divorce he can drop my youngest from the medical coverage & he's the only one on a life saving prescription?

It sounds as though someone is giving you some bad information about your sons medical plan, as the father he may still be required to carry medical on his children, especially if it is a life saving medication. I'm sorry for your troubles, but it sounds as though you are in a situation that one is no worse than the other, although you need to file for bankruptcy, remember that your credit may already be ruined as well it will be with the bankruptcy so where is the real hurry, just put an add in the paper saying you are no longer responsible for any debt incurred by him, then take one day from there and seek some legal advice, there are many things out there that will help you learn what your rights are, try the library and other agencies that have legal assistance.

u seem like ur going thorugh alot but- i think that if i were u i wouldnt' take his money. He molested one of your chidren?? what a bastard. Get your a s s off your seat and get 2 jobs if you have to - to take care of your children but never depend on child support beecause as soon as he looses his job or gets fired you will stop getting the child support moeny ur getting.Good luck and stay away from this guy. Yes- get a divorce before you can file fro bankrupcy so you can divide the debt into to- as a matter of fact you might not even need to file bankruptcy depending on how much you owe. I wouldn't anyway it just looks really bad for you.

First of all go to the website www.allkids.com fill out the app for your kids and get them insured through the state. That is the site if you live in Illinois. You can also go to DHS.com which is department of human services and fill out an app for yourself and your children all together. I have public aid and it is great. I work full time but I still don't get beefits so I am on public aid. Next No you do no have to divorce him to file bankruptcy. You file alone and he ends up having to pay it all, which gives you the satisfaction of screwing him over.

That you picked him says a lot more about you than you think. That you would reconcile with him is just amazing.

You need to know the bankruptcy laws in your state for the correct answer, but most places won't allow you to file separately if you are still married. After all, your debts are joint therefore you would need to file a joint bankruptcy.

If there is a decree for him to pay the child support and the insurance premium, then he cannot stop paying just becasue you get divorced. However, I would think that if he requests a DNA test and can prove the child is not his, then he can probably drop that coverage and financial support.

You can get a better job, working full time....keep looking. Do not stay married to a man who molested your daughter, even if you are separated.

File bankruptcy and then divorce that loser.. Put what you want in the divorce agreement and make him own up to it.
There is alot that you can do and the state can also help you with medical aid as well ,, you need to check into this and talk to a lawyer.You can get legal aid help.

no he cannot drop your child from medical coverage. T file for bankruptcy before divorce you would both have to file. i think he is a danger and you would be nuts to stay with him for any ammount of money

You can not file bankruptcy separate from him. What a jerk? I hope you are in a good church. It sounds like your family is awesome. Does your state have state funded insurance? I wish you the best and hope your kids grow up to be doctors and lawyers

he shouldn't be able to drop the med. coverage since it should be listed in the court papers that he should remain paying child support. If he does you can fight for him to pay that too. Sorry to hear about all this. I think many people including myself take things for granted until we hear other people problems. I hope things work out.

Declare bankruptcy FIRST - it's his financial problem, too. Don't let him off the hook! Once that's taken care of, file for divorce and child support.

P.S. STOP GETTING PREGNANT!
