After I married my husband I found a tax return of his that said he was claiming married filing jointly and there were kids listed on there. We were already not getting along and I was already ready to leave when I found this. When we got our marriage license he said he was never married before. I would love to get a divorce from him but I am also scared of him since when I left I was 3 months pregnant and he has not tried to see this child or anything. He knows were I am and know were I live so its not like he could say he couldnt find me. But to my question how do I find out if he was actually married before because wouldnt that make our marriage void if he didnt disclose he was married before and if he wasnt didnt that mean he lied to the IRS? We had gotten married in October and I left him the last day of Novemeber so wasnt sure if I would also qualify for an annulment either.

the marriage was a result of me being manic (I am bipoar) I know its no excuse but that is what happened. when I left him he had called me and i brought this up and he said he didnt know what i saw but he was never married before and that he never filed as married but the papers were as plain as day. I know where we were married but I dont know where he could have been married before. It has been 3 1/2 yrs since I left him.

is it possible to get a divorce with no contest since we have been apart for over 3 1/2 yrs now with no contact either way?
I dont have the money to file for a divorce right now. So I figured I would ask people on here to see if anyone knew anything about this.

I thought the married would be void since he lied to the courts when applying for our license. I thought you HAD to disclose this info to the courts.

I didnt leave at the first sign of problems. I left because he was abusive to both me and my son (he was from a previous relationship

Marriages are public record but I think they are held by the county, maybe the state recieves the info from each county too. You would have to be sure what state it was and contact them, or just do a background check for about $40 and you have all the background on him you seek . .. and then some.

I do not think the fact that he was married before(if it turns out this way) will void your marriage. I think, it makes him a biggomist and if charges were brought he could go to jail since that is illegal. but remember he needs to be married to more than one during the same time frame.
If there were no children as a result of your marriage, and it is like less than 90 days I think you can get it nullified. If it is more than 90 days, or children were conveived of this union then it would be a divorce based on this biggomist behavior.
Often it is easier to do the no-fault divorce in cases like this, but you can almost guarantee yourself of one thing. In this high-tech information collection age of high security and knowing all there is to know about one's past. It is hghly unlikely that one will get out of a marriage in any form and it will be as if the marriage never happened - no record of it. that I do not see happening period. There will be a record of it no matter what - even if it were nullified, the record will state that fact.

The question you need to ask is not was he married before, but was he 'still married' when he married you. If he had gotten a 'divorce' or an annulment before you got married, then your marriage is 'legal' and you must 'divorce him' or get an annulment. (You may be able to get an annulment, since you are 'bipolar' and were in a 'manic phase' when you had the wedding ... ) In my state (Washington) you can go to a 'free attorney' who does divorces for people who can't afford them otherwise, and I suggest you call your local bar association and ask them if there isn't a similar agency in your own state. I hope you have 'good copies' of the papers you found, because I think you may have been the victim of 'fraud' when you agreed to marry this man ... and if that is true, then the 'divorce or annulment' should be 'free' to you if it is even necessary. TALK TO THE ATTORNEY. Even an attorney who would charge you for the divorce may have a 'free consultation' where you can ask the questions that you NEED TO ASK. Good luck.

first of all why would your marriage be void? if you have a certificate of marriage and it was filed with the courts, then you are (were?) married!
You can also get any record of his previous marriages, they are a matter of public record in the county where he was married at- as well as yours would be recorded. You can also find divorce records there too- which would be a good idea to see if he was married and also divorced before he married you- if not he is guilty of bigamy which IS against the law. You cannot get a marriage annulled unless it was never consummated, yours obviously was if you are pregnant with his kid.

While he was wrong to not tell you about the previous marriage, thats not grounds for divorce. Your marriage is valid so long as he divorced the previous person prior to marrying you. Marriage is going to have some bumps and it seems as though you are getting car sick at the first little turn in the road. This marriage or any other you may have is going to have some ups and downs and you need to learn to weather those storms. I used to be this way...quiting at the first sign of problems...and I went through many relationships as a result of it. I encourage you to toughen up, pray about it, ask God to take away the 'quiting' spirit in you and see if there is any room to reconcile the relationship.

Talk to a lawyer. Your marriage will only be void if he was still married when he married you.

It's on the official marriage certificate, and if you apply for credit anywhere he may have to say if he has been married before.

One might wonder, why are you married to someone you know so little about and cannot talk to or trust?
