Just the other day, I was driving on a busy street, and a man pulled out of a side street and hit my vehicle right in the side. My vehicle went sliding and by the time I gained control of it, I was facing the opposite direction--his hit turned me completely around. This man tried to get away, but others who heard the hit ran and prevented him from leaving the scene. Police showed up, and decided this was not a hit and run as he did not get away. This man has no insurance. We only had limited coverage for other drivers and no uninsured motorist coverage. So we are out of luck with getting the extensive work covered on our vehicle. I was with my children at the time, and we are all fine, and I thank God for that. But considering I did not break the law, isn't there anything that I can do to get money from this man? Also, will he serve time for this? I understand it is against the law to drive without insurance. Your thoughts and suggestions are appreciated.

What state are you in? I know in michigan you will go to jail and lose your liecense. What you have to do is, if your state has a law requiring insurance then go file a warrant against this man. Also you will have to sue the man for punitive damages to your vechicle? Get a copy of the police report and have him served civil papers. Without knowing what state you are in I cannot answer this question?

I wish you luck on this. Actually, unless he has any money or other assets, you may be out of luck. You can file charges in civil court and you will get a judgement against him, but the trouble is he may not have anything and what you get is called a paper judgement.

It may depend on what state you are in even if he gets locked up or not. The laws seem stupid sometimes. Call your insurance agent and see what he suggests you should do.

Well, for one thing, it is not illegal to drive without insurance in all states. Wisconsin for example, it isn't illegal, but if you are in an accident without it, it is automatically your fault, and you are asssumed liable for all costs, even if the other person hit you! As far as what you can do.....All you can do is call him and talk to him about it, and write him letters. Keep very close documentation of how many times you tried to contact him, giving detail to what day/time etc. If he does not respond to that, then all you can do is file for a court date in small claims court. In WI, you can only get $5,000 for small claims, and have to have a lawyer for large claims. The positive side to this is that he will have to pay for court costs and everything else if you win the case, the negative side is that they aren't guaranteed to get your money out of him, all they can do is put a judgement for money against him, and any property he owns. Be sure to bring all of your info to court with you, such as estimates for fixing your car, documentation of you trying to get in contact with him, and your police reports.
In WI, he wouldn't sit jail time for that, but I don't know where you are or what the laws are there. I know that WI is one of the more strict states on hit and run though! I don't know what else to tell you..... If you have anymore questions, let me know!
