Definitely this is a very serious issue for which government should make legislature to prevent misuse of judiciary for frivolous matters where it is already burdened with so many matters of importance for individuals with it. It takes years for even simple matter to be decided & some publicity crazy guys are increasing the burden of judiciary by filing frivolous & non issue matters. The Supreme Court has already instructed the lower judiciaries to avoid such matters & should dismiss them outright but some lower court judges find these so called PIL amassing & hence hear them & even issue summons & warrants to the concerned parties, although these matters finally end in a compromise where the litigant/petitioner gets some monetary gain along with free from press & media publicity on the cost of valuable time of other serious litigants. The government should not only make legislature against filing of such frivolous matters but even make it a punishable offence for who ever do so.

The courts are fully empowered to reject frivolous PILs at the outset by not admitting them. One should never lose the right to file a PIL. It is up to the higher judiciary to set standards and proper guidelines for the lower judiciary to follow.

Legal barriers are there and as such, Hon'ble Courts are imposing heavy fine on such litigants. PIL should merit PI and NOT any political motive ( to gain in Vote Bank only ).

I suggest you look at the Federal Rules of Civil Procedure, specifically Rule 11. There are such barriers already in place. Also, look at Tort Reform statutes. Most states have them.
