I'm just curious, is it unlawful to keep an item that has been confiscated forever? I just remember when I was younger, I got items taken from me and the teacher/elder that took the item would say, "It's mine now!", and I never got it back.

So, is it unlawful for the confiscator to keep the item for good this day and age? I'm sure it is, because it seems like they are stealing the item.

Thank you!

Teachers are allowed to take distubing and prohibited items from students for a reasonable amount of time.

Example: Cell phone

It rings one ....2 days
It rings a second time... a week
It rinngs a third time.... a pattern is forming the student might need to be suspended/parents called ect...

But it is almsot certainly never reasonable to permanently confiscate an item....after the reasonable time period usually set by school policy it becomes theft.

I'll bet if you asked nice enough at the end of the school year, you could have got them back.
