Landlords need to pay the mortgage like anybody else. It is is the sidewalk, it is city property and you'll need to sue them. I don't think you'll get much other than lot's of headaches for yourself, but go for it if you think you can win.
I can tell you if you were trying to sue me, I would have private investigators watching and filming your every move. Also, you should hope they don't file a counter case against you, because you'll need lots of money to fight it. I would have a team of lawyers on you.

Anyone would know that cinderblocks could be loose. You knew they were there, and from what you say, you even knew it was loose. Had you told your landlord this prior to your misstep? And you're ready to sue? I doubt you'd find a lawyer to take the case.

I dont think there is a case at all unless you have asked him before in the past to fix that block because it was use. Good luck tough, I recommend consulting a lawyer who specificaly handles these types of cases.

You'll be lucky to get an attorney to take it. The person in the best position to know this was there, was YOU. Did you report it? If not, how would your landlord even know? If you knew it was there, then try explaining why you tripped over it.

get a personal injury lawyer - they will help you get the papers collected, your billings collected for any doctors/hospital stays and present them to your landlord/ or whomever is supposed to handle the care and maintenance of the property.
Love how everyone is jumping to the conclusion that its the victims fault. she did not state whether she knew it was loose, only that because it was loose, she lost her footing and hurt herself. And its not her responsibility to report something is potentially dangerous, if SHE didn't realize it would become dangerous.
the landlord is ALWAYS responsible for the upkeep and safety of their property or whomever they hired to maintain it.

My advise is, get over it. You don't have a law suit here. Don't waste your time, concentrate on getting well. Take the landlord to small claims court and recover your medical costs.

Maybe you can talk (first) to her, maybe she would like to help you since we all have to have home insurance. Like that, you wont spend more money paying to a lawyer.
Once something like that happened to me, but in my case it happened in a shop, the owner of the shop was the first one to send me a check so I could take care of my foot, for me that was enough....talk to the land lord first....wood luck and hope you feel better.

You need to report this to the landlord first. She may be happy, and willing to pay for medical damages.
If not, then get a lawyer.
