My husband and I want to purchase a home, Can he get financing without disclosing that he is married so he is on the house note by himself. HIs credit is great and mine is horrible and I know if they want to pull both our credit, we won't get financed.

The short answer is yes. However he can apply for the mortgage himself. The downside of this is that the property will be in his name only. If something happens the property will not automatically revert to you, it will have to go through probate. You will most likely get it but it would involve the courts. Talk with a mortgage lender about your options.

Yes, you have to disclose. Your tax records will show you as married anyway, may as well face the music.

If you do not live in a community property state he can buy the house and keep you completely out of it. Otherwise, he married your credit score too.

I used to work in a legal services office, and the short answer is yes, he could be the only one on the house deed, BUT if a signed document asks whether he's single or married, if he answers single, he's perjured himself and it's considered fraud. So the crucial part is whether any document he signs specifically asks whether he's single or married.

Yes, you must disclose your marital status. However, he may be able to qualify on his own for a mortgage nonetheless. Contact a qualified mortgage broker/lender, explain your situation and do the best you can.

You don't have to both be on the loan just because you are married. I work for a mortgage company and you may both have to be on the deed, but not the loan.

He doesn't have to deny that he's married. All he has to do it apply for the mortgage in his own name, and not list you on the mortgage. He just applies for the loan in his own name.
