Ok here is the situation that I am in. I parked my truck in the plaza where I went into the 24 hour fitness. I believe that 24 owns most of the parking lot but I am not sure. There are other stores who put up signs and other things for their parking only. Ow yeah this is at around 12:18 to 1:45 in the AFTERNOON!! There are no signs posted saying that they are not liable for anything that happens in the parking lot. I parked about 45 yards away from the front door. They have two cameras but were not pointed at my truck. They were only pointed at the front door and some of the cars in the parking lot. I also installed a Viper alarm (viper only offers a one year policy on their alarms) at Best Buy about 3 years ago and the alarm didn’t go off at all. The criminals popped off the outside lock and ransacked my truck. I need to know what I can do if anything to make any of these companies pay for the damages to my truck. I ned to know what i need to know or find out and what i can do!!

Its do not want to go through my insurance!! They will not replace items inside my truck that i left in there. I lost my 600$ in-dash touch screen tv, they broke my ignition, my outside lock, in dash etc. I really want to sue some one!! so i need to know if i have a case andif i do then under what circumstances and what legal actions do i have.

This is not the first time this has happened in this parking lot if that makes any difference.

they are not liable for any theft or break-in on your truck.
your beef is with your insurance company


then its too bad; if you dont want to file with your insurance company than you SOL. That's what insurance is for. Of course they wont replace everything, but that's your problem. Not the problem of the owners of the lot you parked at

Are you going to SUE yourself if your truck was broken into on YOUR property at home? No, you'd be taking it up with your insurance company.

Why dont you file a police report and get them to find the crimiinals and YOU can SUE them for your loss?

They're not going to be liable for this. A crime was committed that they had no control over, and had no reason to suspect would happen. Bottom line you'll have to file a police report and then file a claim with YOUR insurance carrier.

Bottom line is the criminals are the ones that will have to pay, and once they are found your insurance company will file suit to get back what they pay out to fix your truck.

First off you have no claim against the owner of the lot unless you can prove gross negligence which doesn't sound likely. You can try and sue viper but you have to prove that they knowingly and fraudulently misrepresented their product and the failure of the system was not a matter of being incorrectly installed or an item which broke after the stated warranty. Both of these can be very expensive to pursue and will come down to a he said she said.

Does it have electric locks?..... In my area of the USA is gets real cold.... That's when electric locks don't work well..... May car thief's know this.... They stop by a parking lot full of cars when its real cold and start checking doors... Most people hit the lock button thinking the doors lock when in reality many doors lock mechanisms don't work well when its frigid out.... Was it real cold when he hit the power lock button?......
