I allowed my sister to use my ID to travel back in forth to work because she had her license taken away due to having 2 DUI's. She was pulled over and told the officer she was me. The officer figured out that was a lie and called me to ask if I had given her permission to do so. I have not called the officer back yet and am wondring what kind of trouble i am looking at if i lie for my sister. I am looking for legal answers, not personal opinions on whether you believe this is immoral or not. Thank you for your help.

Thanks for the responses, i didnt actually ever give her permission to use my name or ID, just thought id get more response that way. She didnt tell me she was gonna do that, but she is family, and i do want to protect her, but not at my expense. I do not want me niece to be without her mother, but i also will not jepordize me and my daughter. What does that law say my range of punishment could be if I tell the officer she was allowed to do use my name, that way atleast one felony charge would be dropped against her.

If you HAD allowed her to use your ID, you could be guilty of conspiracy to commit the offense and/or being an aider and abettor to the offense. If you LIE about it, you could be guilty of giving false information to a police officer.

You do not have to tell the police anything, but if you do discuss the matter with them, do not lie.

You really should contact an Attorney especially your Sis. Both of you can get into trouble. Your sister can get her probation revoked from the DUI's for driving on a suspended license get a probation violation (if she is still on probation from the DUI's) and can be charged with falsely impersonating you. As for you I am not really sure...but I am sure that you'll get something..I don't want to give you bad info for what could happen to you. You should really contact an attorney to at least to find out if it's worth it to you but your sis needs one that much I do know. Hope this helped.

Read your post again....don't lie for her it won't help, she isn't a child and she is already in BIG trouble. If you lie you'll just be getting yourself into trouble and not help her in anyway. To try to get any penalties reduced or charges dropped she needs a lawyer so that they can consolidate everything rather then everything being charged separately which can be worse for her because each charge carries seperate penalties.

Both parties are breaking the law. Both can for different reasons be fined and or go to jail. You are committing a crime when you defraud the court to go around a judgment. Your sister is using a false identity.

well. legally, she's committing fraud and she will be held for that crime

for you, since you let her do it, you can be held as an accomplice, your insurance carrier notified, and you could have your license revoked.

you enabled your sister to not take responsibility for her actions and endure her punishment; maybe you should join her in her punishment by not being able to drive as well.

Yes you can be in trouble for conspircy to commit a crime. This also means in some states that you can also be held liable for the crime she committed because of the fact that you conspired to allow her to commit a crime.
