I am a Landlord in the State of Michigan & I have a person Living/Renting from me with no contract with me, But says she is getting Disabilty from S.S. & Humane Services.Can I evict her legally?

She Has "NO LEASE", all she dose is sits around my house all day/night and watches t.v., trun up the heat, and I have to ask for the rent every month,and don't even get it for about 7or 8 days after it is due.This has been going on for about 4 months now.I want her out now!?!?

You can evict anyone from a place you own as long as you have one of the acceptable reasons. See the first site below about that.

If you have no written agreement to let the person stay any particular amount of time, you can give the person a notice of termination and she will have to leave within 30 days. Her being on disability does not affect this.

Edit: When there is no written lease, there is an understood month-to-month lease and you can terminate this at will with 30-days notice. This is NOT eviction and there are no legal requirements as to the reason for termination and disability does not affect it whatsoever.

You need to check with a lawyer, because of the fact she is on disability you may not be able to evict her depending on the laws in MI AND if she's paying the rent with any type of housing support. You can possibly also be barred from ending the lease because of her status.

Bottom line is that you need to get with a lawyer (usually they can give you a free 1st consultation) to determine what if any action can be taken.

To James being on disability does have a barring, because of the fact she is probably having rent paid for by the government. This gives rise to a number of possible roadblocks to being able to evict her.

Also note if she can show you are taking action because of the fact she is disabled you'll probably lose ownership of that house and most of your assests since you can't discriminate on the basis of disability.

Yes, but you need to do it according to your state law. Even if there is no contract, she is still a tenant. You will need to see if your state allows you the 30 day/60 day/90 day eviction notice

Consult a lawyer (this kind of thing is usually cheap to do).

edit to add: your reasons for evicting her is of your personal choice. you can evict her for any reason; as long as you follow your states eviction's laws.

Even if she is "disabled" she has to abide by the laws as well.

That's charming. Evicting someone just because she has a disability.
I don't know the answer, but I sure hope it's 'no.'
