I am married but my husband is threatening divorce and wants sole custody of our son, without letting me see him. Can I leave and move 5 hours away with our son without any legal repercussions? It will still be in-state and will be before the divorce.

I am going to go against the grain here and say if nothing is filed barring you to leave the city, then you will have done nothing wrong. That is not kidnapping your child.
With the distance, you will more than likely have to drive to meet at a halfway point so your son can continue to see your husband. And will be something for you to consider since gas is so high.
But, like you said, it will still be in the same state.
The only way he would be able to get sole custody is if you have been a very bad mother. If this is not the case, don't worry to much about it.
Just make sure he knows ahead of time where you are moving to, make sure he can contact his son. And always make sure you are there on time when it is his turn to visit.

I live in Missouri and went through a divorce with kids. My ex decided he wanted a divorce so I went and got a U-Haul while he was at work loaded it up and moved 2 hours away to my mothers. It was not illegal in anyway as long as I let him know a number to contact me at and of course had to furnish address. In this state whover has the child when a divorce is filed has custody until the matter can be decided in court so make sure you have your son when it is filed and if possible file yourself. I made arrangements for my ex to talk to the kids and to visit them until we went to court but he was not allowed to leave with them until I had an order in writing from the judge my attorney and his both said that was my right. It is very hard here for a man to get sole custody and you have to be an unfit mother in order for tht to happen money has nothing to do with that. God luck feel free to contact me.

while your married you both legally have a right to the child, however once the divorce is over they will deal with the custody issue there. if you leave without telling him where you are going you could be reported as missing. You should call your local police agency and ask them that question, and then call around for agencies like middlway home for battered women, they will also have answers even if you were not in a abusive relationship.

Men kill me with the "I'm going for custody!" thing. Get an attorney, legal aide representative. If he makes all the money, then go to his boss at work or someone at his EAP (employee assistance office) office. Tell them that you and your husband are having problems and he wants a divorce. He'll be pissed but then he'd also be embarassed. Get out just make sure that you move legally or you'll be the one in trouble.

Yeah running away with your kid is against the law. Why don't you just do it the normal way and get a lawyer? Are you a bad mother and scared that they will give the father sole custody? Men really get screwed over on this, it's disgusting.

Your husband is full of hot air. Let him talk all the crap he wants and maybe his head will explode.
Just keep all the voice messages, email, and keep notes of all his threats. It will go against him.

If you stay within state lines there shouldn't be an issue.
Hopefully you can find a decent paying job.

If you run away. Then one day your son will find out, and it will not reflect a good view of you as a mother. You will have to do it legally.

they will have a warrant out for you... dont try it
get a good lawyer
unless you have been a REALLY bad mother, he cant win the case against you
