I said get out, pushed his shoulders and he said "why?"

So I'm thinking it was clear.

I agree it's not the best place, but I'm in a foreign country and I need an objective opinion to see what I'm up against. Yeah I would be on trial.
I've gotten some nasty remarks trust me, but it gives me time to formulate arguments so that helps.

rape. you made it clear to him that you didn't want to have sex with him. you even got defensive enough to slap him. report it, don't wait too long.

It's still rape. Even if you passed out. It doesn't even matter if at one point in time either of you said you were joking around. The police and a damned good attorney would see that this person never was able to do it again without becoming someones "girlfriend" whilst in prison.

If you say NO, and they do it anyways, it's clearly that. If it made you feel insecure and really not sure of what to do, and upset and depressed, then yes it is.
No one can force you to do something against your will. If you pass out and he/she does, then yeah it is.
I have had a lot of friends who have been raped, and it's hard. I would go get a rape kit done. You never know what happens with things like that. Its always safe to know for sure, and make sure your not pregnant.
That is a terrible thing to have gone through. But, asking on Answers.com isn't what you should be doing hon.
Make sure, to report it. Otherwise, you never know if it will happen again.

No means no. And if you make clear to someone that you don't want sex, by the word or by action like you say, and someone forces you to have sex against your will, then it is rape.

You passed out and then this person had sex with you? After you told him to get out?
That is rape!

Yes, if you said no. (Which is sounds like you did IMO.) I think just about any legal system would agree.

anytime u say no, and they don't stop it's considered rape but hard to prove in a court. u would be the one on trial

Yes. You're telling that person you don't want them around, especially sexually.
