About that guy who quit his job and spent his life savings living lavishly after being told he had pancreatic cancer and only 2 years to live........only to be told when his money was all gone that the diagnoses was incorrect and that he actualy had pancreatitis ( a treatable condition ). Do you think he should get some form of compensation from the diagnosing hospital ? He says he does not want to take the hospital to court.

No I don't think he should. Medicine is NOT an exact science. People have this mistaken thought that it is, and when something happens feel they need to sue for something that is never a 100% thing to begin with.

No I don't think he should get anything. The doctors diagnosed him with the evidence at hand and did not make an intentionald or negligent error - they simply made an error. Medicine is not exact - you can only look at the test results and come to a diagnosis with a reasonable degree of medical certainty, not an absolute.

I really feel sorry for him. Yes, he should be celebrating, but he will probably be homeless, with no savings. He even has no clothes!
I think if you went to a surgeon and they cut off the wrong foot, you would be compensated. So yes, I think the hospital should compensate him - not because medicine doesn't make mistakes, but because through its mistake, he was led to believe that he was dying, and this knowledge caused him to lose his life savings.

No. First, he would have to sue the doctor, not a hospital. Secondly, he would have to show that malpractice caused some injury. If the erroneous diagnosis caused him to have a nervous breakdown, he would have a claim.

LIKELY,He was well informed about his conditions, thats why he refused to persuade for the cause. otherwise he would.
