A couple of months ago, the court in Summit county Ohio sent my husband and I a questionaire to fill out so that his ex is charged with contempt of court for non payment of child support (she owes over 3000 dollars and hasn't paid in a year). How long does it take for it to get filed and go to court? Are there any other remedies? Any answers appreciated, but people who know Ohio would really help...

We aren't trying to be vindictive, but we do feel (due to many circumstances) that she should support her son...

That 3000 dollars she owes is alot to us, first of all... and it doesn't include the 3000 dollars she essentially stole from us.

To be honest, I'd just love to adopt my stepson and drop the child support all together, but it doesn't seem to be easy to do that either.

I just want to know how long between sending in the questionaire and the case being filed. Just so we have some idea of how long we have to deal with this.

Then file your adoption papers, the back child support can be used as leverage, and has been done thousands of times. She can pay and go to jail, or be free and give up her son. You would be surprised at what people would do to avoid going to jail.

never put your trust in any court ever for anything. They all are a money making enterprise for ever one but you..Take a tip from some one who knows settle with the x with just about any amount ,be live me it will save you more in the long run. might help in the future I know. These court people laugh when they see you seeking justice All the Judges want is to be paid same for the lawers. You need to simply settle in some parking lot. Try it have faith in the right thing learn to accept less not more . ower, clerks drive paid for by you if you let them. What I actually mean to say is **** the courts settle in some parking with a handshake and a pro mice skip the court es.

They try really hard not to jail the fathers because if they are in jail, they can't pay the support either. Ask for a wage assignment to be put in place for the current amount of support due each month and an additional amount for arrearages. You should also be getting any income tax refunds via intercept that he files.

I'm a legal aid in Ohio and I wouldn't attempt to answer your question. It's too important. Get an attorney!

People are so vindictive and horrible. Its a lousy 3000 dollars. And I'm willing to bet that half of that is "court costs" and "interest". I'm so glad I don't live in the U.S.A., home of the oppressed and hated. Bleh.

They will likely handle it for you. If his ex doesn't pay, they will eventually put her in jail. How long it takes to solve the case depends on your states proceedures, the court backlog, and if they have trouble findind his ex. good luck, jason

First, she doesn't owe it to "us", she owes it to "him", unless everything that's his is also yours. You should be asking the court those questions. In my opinion, everything takes longer than it should, in some cases far longer. Please understand that she may not HAVE the money. AND the court will add fines, that obviously will need to be paid FIRST, further adding to the wait.

I'd be very surprised if they sent a woman to jail over non payment.
