If she is drinking from a beer bottle or admits to what is in her glass then, yes, they can.
It MIGHT be easy to get out of though. She could say she put water in the container and faked it to be cool because the police do not have breathalyzer test results. It's kinda lame but it could work.

They can issue the ticket, but she can contest it in court. It depends on how detailed the pictures were. If it's just your friend drinking a beer in a pint glass then the prosecution will be hard pressed to prove that the substance was alcohol.
If she's clearly drinking out of a beer can with a label, the judge may find that to be evidence enough, to side with the prosecution.
If there are no pictures of her drinking, and the pictures can only prove that she just attended the party, then she should definitely fight this. (even if she was drinking)

Yes. Absolutely. Images posted on Myspace have been used to prosecute the people posting the images.
Photographs are considered valid evidence. Security cameras are used to fight crime and catch criminals. Myspace photos are no different.

why would the cop be looking on my space for her in the first place ?? i would not think that she would have a problem as who can prove what the actual content of the drink in the photograph really was. suppose it's a beer can, who knows she might have even been pretending to drink from an empty can.

If the police have a picture of you holding a smoking gun while standing over a dead body they can arrest you on suspicion of murder.
The rest is up to the judge.

They would have to prove the picture was not altered in any way. And with digital cameras so easy to manipulate, it would be a tough thing to prove.
