Married in Jesup, GA on 8-11-90, but the license was not filed. We separated on 3-22-02 w/o having any children together (Each of us had three by previous marriages). During the time we were together, we migrated between the Jesup area and Clark County, IN area. There were no pre-nuptual agreements. It's my understanding that neither GA nor IN recognize "common-law" marriages. So, under these circumstances, do I need to get divorced before I get remarried?

Depends on the State. My understanding is that in most states you get a marriage license, which becomes a legal marriage certificate only if a legal ceremony is performed, the license is signed by all parties and then filed with the state. If this does not happen, the marriage license expires after a length of time (30 or 90 days or whatever depending on the State).

If your marriage was never legal, you may not need to get a divorce. However, you need to gather the relevant paperwork and ask a lawyer to make sure.... if you don't and get married again without ending your previous marriage legally, you will be committing a crime -- bigamy.

So, make sure, and if it ends up you don't need to go through a legal dissolution (divorce) then it won't cost you much to find that out from a lawyer. If it ends up you do need a legal dissolution, well, you need a lawyer anyway.

Yes. Just because the license was not filed does not mean that you were legally married. While there is common law marriage in some states - there is no such thing as a common law divorce. File the paperwork and that way there will be no little time bombs down the road.

returned in Jesus' time Jesus become in fact getting onto the Pharisees for turning out to be all varieties of loopholes so extra human beings might desire to get divorced. Like a guy might desire to divorce his spouse for burning dinner and stupid issues like that. in case you moreover mght word the Bible is extra approximately promptly marriages and not gay marriages. It additionally does point out divorce for being abused because little interest become paid to that concern returned in Jesus' time additionally. It does say it is okay to divorce a non-Christian if between the significant different's will become a Christian, however the different significant different is truthfully adamant against it (a million Cor. 7:12-sixteen). All in all, i've got self assurance God would not like divorce in any respect, yet there are some circumstances the place it is in basic terms extra healthy for the two spouses. It truly relies upon on what the couple is getting divorced over to initiate with. The 4 ultimate motives that I undergo in suggestions from premarital classification for divorce (no longer so as) are funds, parenting alterations, in-rules, and intercourse themes. returned, whilst it is composed of divorce i've got self assurance God needs His babies to have healthful relationships, yet sometimes that in simple terms isn't a possibility simply by fact one significant different refuses to alter and supply up being violent or supply up playing or despite is it truly is inflicting the family members to truly cave in. seek for counseling first to locate the concern extra to work out if it truly is an argument which may be dealt with and solved over the years or if it is in simple terms no longer secure to be around the different individual. wish this enables!
