Any legal advice if the choose not to honor the claim?

What is my legal recourse to fight this? The bill was due on 4/6/07, which I thought I paid. If I didn't, could they legally cancel my policy as of 4/30/07? Or do they have to give 30 days from payment due date? Still, though I never recieved notice.The only reason I even found out the policy was cancelled was because of my accident. Payments left are 2 each of $213.40 to be covered untill August 6th. I actually have a statement from them from a previous yet recent month saying that they were late on sending us our statement so they had to give us extra time to pay.(not this month though)

My insurance card that I had in my car showed that I was current.

Most states require you to carry proof of insurance in your car. The card has the dates your policy is in effect. If the date passes and you don't have a new card, YOU are at fault. The insurance company does not have to inform you of the current date. Your FORMER insurance company probably will deny the claim because you no longer have a policy.

It was your fault that coverage was cancelled, thus you will not have coverage. One bad thing is now even if you where not at fault in causing the accident, you will now be considered at fault since you where driving illegally without insurance.

Sue your insurance company. It is their fault you got in the accident and did not know you were driving illegally without insurance.
