Your additional information states the death penalty is "unjust because it is unlawful". That is a false argument for ANY issue. By that logic, if we passed a law prohibiting victims of crime from suing for damages, it would be 'unjust' to award them damages. I believe we all agree that in not the case.

Murder is regulated and legislated by the 50 state govts. It isn't a federal offense, except under certain circumstances.

i don't know the names but the laws that outline the type of Murder like 1st degree premeditated so you get a heavier sentence than manslaughter which is kind of like i killed them accidental in fight
