If the arguement is that people are born homosexual and they have to live that way. Then wouldn't you have to say that a thief is born a thief. and if they are born with those tendences how can we put them in jail. they can't control their actions. A person can plead temporary insanity and if it is found to be true, is let go because they didn't have control. if a person is born to be a thief, does he really have control over his actions?

reading the answers here, it sounds like people are saying that a person who lives the lifestyle of a thief is wrong, however a person who lives the homosexual lifestyle is inprisoned...we are talking about people's desires. If a person could be born homosexual, then a person could have a gene that makes them a murderer or a thief.

Even if a person is both with the natural talent and inclination to be a thief, they still have the choice to ACT on that urge or not. They are punished for the act, not the urge.
Homosexuals likewise may be "born" homosexual (although this may also develop later in life), but they CHOOSE to act on it, just as heterosexuals CHOOSE when and how they want to be sexually active.
The upshot is that everyone is responsible for their actions, no matter what their inclinations. So if you're going to condemn homosexuals, base your arguments on their actions, not their inherent nature. So far, you haven't submitted any argument about why homosexual sexual activity is wrong... and there really isn't any objective argument that it IS wrong.

Your argument fails for three main reasons.
First, people are not born homosexual. Homosexuality is largely determined by genetics, yes, but not entirely. However, the combination of genetic and environmental effects determine the child's sexual orientation at quite an early age, well before the child has any real concept of sexual orientation.
Second, and more importantly, people are not born thieves. Only a few thieves steal because they can't control their impulses, and even those that do were almost never born that way.
Third, and far more importantly still, stealing people's property is immoral and bad, but being homosexual is not immoral or bad, so whether or not homosexuals are born that way there is no good reason to throw them in jail.

lets see here....when a gay person does gay things, im not mising money or a tv or hurt in any way. they just do their gay thing and have a great gay time. when a thief steals from me i lose something. they hurt me for stealing what i had. by your measure should we make it ok for people born to kill get away with murder? or let child molestors go because they cant help the way they feel about kids? there is nothing wrong with being gay and for you to compare a homosexual with a crime is about as ridiculous as comparing apples to oranges.

Contary to your beliefs, people who plead insanity often spend more time institutionalized. That is a statistical fact in the U.S.
Homosexuals are not necessarily born that way. Thieves make a decision to steal. Their "crimes" aren't as comparable.
70% of inmates with convictions of violence have similar genetic traits. But the concept of Christianity greatly impacts the American Judicial System. You cannot charge someone for a crime that they may commit.
BEING GAY IS A CRIME!!! IN IRAN I WOULD BE EXECUTED! Americans never see the bigger picture.

There is not a genetic reason for being a thief. It's something that can be controlled, you do it because you want to. Unless there is a medical problem such as kleptomania or schizophrenia.

It's a spurious argument. A thief steals from people, and thereby hurts people. Two consenting adults that are gay don't hurt anybody. And no, I'm not gay, just somewhat disgusted with homophobia and any other form of hate based on a difference of opinion.

Stealing is against the law. Homosexuality is not.
Stealing hurts others. Homosexuality does not.
