he has waited over a year to do this and he forced me out of the home. He stated to me that he would have to police remove me from the property if i was not out in 24 hours! so we left that night! then we came back the next day to find a note posted on the door tellin us to clean the home. we stayed and cleaned the house from top to bottom and they are still sueing us for cleaning and all this other stuff....HELP

we were forced out of the home b/c we didnt contact him to let him know our rent was going to be late. Yes we did have a a year lease and this is in the state of West Virginia. NO we had no prior notice we arrived home around 11pm that night and there was a message on our answering machine to leave the property. THE LANDLORD IS NOT MY EX!!!!!!!!!! My ex and I are the ones being sued....

You don't give enough information to give you an answer. Why were you forced out, for not paying your rent.. the house was going up for sale, he wanted to rent it to some one else... did you have a lease, etc.? What state are you in, in my state that have to give you notice before 24 hours, did you have a notice and just didn't move? Fill in some blanks and maybe someone could give you an answer.

Check the laws of your state - there are procedures a landlord has to go through to have a legitimate claim on money. For example, where I live a landlord must make a good faith effort to inform you of any outstanding money owed within 30 days of the end of your tenancy.

I got sent to collections erroneously (they had terrible record keeping, and I've just ordered old check copies to show that) by an old management company (2 years later!!!), and had to look all this stuff up.

Find out what you're rights are, find any old records you can, and go from there.

it's illegal to just kick someone out like that (24 hour notice) at least a month's notice is legal and please check how long a person can wait to sue about supposing to owe rent because there is a time limit on that. A judge would look at that like "why a year later"?! and especially your ex it seems to me maybe he's mad cause y'all broke up and trying to get u back u can say "judge he's suing me only because the relationship is over"

you will need to fight this one, and show up in court on the date, failure will lead to a judgment against you even if you are in the right

now did the landlord send you an accounting of your security deposit within the time frame required by your state, usually at most 30 days, failure to do so will entitled to you complete return of your SD and estopped landlord from moving for damages

so show up in court of the date

If you owe money, you simply owe money. Why not settle your debt? Or make arrangements to settle your debt? If you owe the landlord, they would be within their rights to sue. You can talk and make arrangements like over monthly installments.

Pay for the damages, you don't want this on your civil record. Pay him and move on with your life.

Im surprised you told him your new address but if he waited a year its a slim case . why don't you counter sue for him evicting you without notice! you could get even more like Hotel bills.

check your laws if he is sueing you and its over a year old chances are his time ran out to sue you.
