You could be cited to court for contempt if there is a support order and you are at least 30 days behind. She cannot lock you up...only a judge can do that.

Sounds like she is trying to control you even after all of this time. As long as you are paying something, they won't do anything about it. IF you get ill or have to be in the hospital, get documentation and they will accept that too.
If she runs in there to often making a scene, they will drop her like a hot potato, I know someone who kept going in for an increase every few months and they dropped the whole thing down to the bare minimum, so let her threaten away, just keep doing what you are doing!

i don't think she can have you jailed for that. you are making your payments with a minimum amount of fallbacks. it takes alot more than 3k for the county to issue an arrest or drivers license suspension. don't let the arrears get to high though so keep paing as much as you can. pay even 25.00 more to go towards arrears. shows you are making the effort. if and when you get so backed up that the county takes action they will inform you first and it will be them to do it. your wife can't just decide to have you tossed in jail. imagine all the bitter x's having their x's tossed every time they get a little peeved. the jails would be overcrowded even more than they are.

No but the courts can. I don't think that they would seeing how, like you said, you are making an effort to play catch up on the back payments. Dead beat Dads all over this world make it tough on those who really are doing their best. Don't let her threats scare you. Just do the best you can to catch up on your payments and if you need to go to court, do so first and have them adjust you support payments to match your income and expense needs. Your children need your financial support and you. You also need to be able to have a place that they can come to and feel safe. Everything cost money. Do the right thing.

If you have been consistently paying, then no she cannot throw you in jail. However, if you have not been paying then yes you could be arrested and put in jail for 30 days. I wouldn't waste any money on an attorney though. Just make sure you have receipts for what you have given her if it hasn't gone through the courts.

she can't but a judge can.
I don't see if you say you've only missed a couple of payments, as long as they are not recent, you should fare OK against her. Document everything, even the additional money for those missed payments.
Judges have a anal issue with men and child support so just be careful.

SHE can't do that, but the courts can. They typically revoke your drivers license for non-payment of child support. You need to get a legal agreement drawn up showing an exact payment plan and then stick to the plan to avoid legal actions.

Wow, sounds like she is just mad at you, talk to a lawyer and see if what she says is fact...You get an A for effort...from past experience Mine never paid me any...but to be honest I was better off not having to deal with his BS....so it became a fair swap ...lol

they won't jail you because you don't have a contempt of court order out against you....nor do you have warrant for your arrest. There is a lot the courts do before it gets to that point. If you're paying they won't jail you...that's for the deadbeats!

She's probably blowing smoke, but it might be best to call your case worker in the Georgia Child Support division and ask them what your account status is.
