I recently bought a DVD set online. When it arrived the box was damaged. I asked for a refund and they said that I would have to send the DVD back. I did not want to do that (the DVDs themselves worked fine). I did not want to pay out of my own pocket to send it back. So I told them to forget the refund and that I would just keep the package.
They wrote back and told me to send the package back and they would refund it. I stated again that I would keep the item. They said that it was obvious that I had been trying to scam them I wrote back and told them that the transaction was complete and we were done. I also went and left feedback on the ordering site in the negative column but I stuck to the facts and simply stated the product had been damaged when it came.
The next day I recieved an email stating that since I had left negative feedback that this was slander and that I would be hearing from their attorneys.
So my question is can they sue me for that?

First of all they are just trying to scare you because their mad about the feedback you gave. And second, don't even worry about it. Giving them negative feedback is your choice. You told the truth because when buying a DVD set the box is part of the product too! And it makes complete sense to me that you refused to get the refund when you had to put up money to send it back. You probably assumed that they would pay for that. Just go ahead and take a picture of the damaged box and keep to the truth in your explanation in case these idiots want to waste their time and money taking them to court. What you did was not libel and the truth is your best defense.

It would cost them more to pay their attorneys to deal with it. They're just sad people trying to frighten you. If it's eBay, send the email to eBay and tell them they're threatening you. eBay will probably tell you there's nothing they can do, but I've been in situations where I know eBay said something to the member even though they told me they couldn't do anything about it.

But they did offer you a refund, so I don't know why you gave them bad feedback in the first place.

Truth is an absolute defense to an action for defamation, slander or libel. Also, it seems pretty clear that you posted on a site asking for your opinion. It is very difficult to say that an opinion is libelous or slanderous.

I wouldn't worry about it.

Yes, they can. You stated on your feedback that the "product" itself was damaged. The product was not damaged only the box.

First, slander is spoken, libel is written. You did not commit slander.

Since you stuck to the facts, you also did not commit libel, in my opinion.
