My mother got married years ago to this american citizen who was a very nice person a first. He petitioned me and my mother in order for us to stay in the u.s.

Unfortunately, My immigrant status is just a temporary status for the first 2 years. It has this condition that my mom should remain married to my stepfather so that we can remove that restriction after 2 years.

My stepfather is very abusive and we couldnt take it any longer so they decided to get divorce.

The problem is, Me and my mom needs to get that condition removed but they are already seperated (not divorced). My stepfather is needed in this interview that is scheduled next week.

If my stepfather wont show up anymore and they are really gonna get divorced.. Are we gonna be deported for the u.s?

My mom is a professional.. has a stable job and everything.

I go to college.. straight A's and I have a stable job.

Why does this matter? I heared that they'll take a look at how we're doing and base there if we can stay or not.

actually NO.....i am sort of going tru the same process.. and you guyz can actually contest that condition by yourself.. Your mother just has to show proof of the sepration and ofcourse reasons for seperation will be in that and you guyz will be good:)

The two year stipulation was put into effect to stop people getting married simply to obtain a green card. By law yes you could indeed be deported. My advice would be to contact an immigration attorney and find out if there legal way to continue your residency in the U.S. Good luck to you I hope it works out

Well I really hope you have good lawyers, If not get one! Fill for an extention on your temp status. Make sure your mother has a good stable job. If you are old enof you need to have one also. And your mother needs to file for alomony and take that abusive SOB to the bank. Make sure your mom sues for him to also pay her layer fees.

this sounds like a question for (super) immigration lawyer. you don't want to ask us hacks. we know jack about your problem & our rsvps just might get you outta here sooner than you think. deported (to) where? you might be deported "from" usa not "for" usa. makes better sense my way & is in correct english form -- your last sentence in your statement . anyway & for sure! contact a REAL expert & not us bozos, ok? and good luck!

I really don't know, but maybe your Mama would find
a nicer person to marry back home where she came
from. Maybe you might like her home there better than
here. Give it a try.
