It's easier for police to search an auto without a warrant. For example, if you're stopped for some routine thing, such as speeding or lights not operating, and they observe a weapon or drugs inside the car, they can search without a warrant. In other cases, they do need a warrant. If you have been subject to a warrantless search, and anything incriminating was found, you should consult an attorney.

In most situations it would be silly not to; the fourth amendment also states that the State has the right to search without a warrant if "probable cause" is present, and that is at the discretion of the officer. Refusal to allow an officer to search when they are already suspicious is just going to make them more suspicious and probably aggravated too. Standing up for your rights is nice and all, but do you really want to waste your time fighting about it when it takes them five minutes to poke around your trunk? Especially when all it will get them is some empty fast-food containers and a spare tire kit?

Frankly, I really don't have an issue with cops looking in my car....do YOU?
Besides, they can have a search warrant issued in less than thirty minutes where I live, which could result in the vehicle being towed to an impound lot, drug sniffing dogs called out and a team of cops removing the interior before you finally get the car back. Sheeze, cut the cops some slack. Don't you think their jobs are tough enough?

A few months ago, I was coming out of the parkade at the mall, and the bank across from the parkade (about 50 feet away) was being robbed. I just happened to leave when the robbers made their get away. I was stopped, and the Special Opps, officers (there were two watching the parkade) asked if they could search the vehicle, and my person. Since I didn't know what was going on, but saw about 20 police cars, and a Special Opps, van. I didn't argue, turned the truck off, handed him the keys, and opened to door from the outside handle. I told him about the pocket knife in my pocket, and the exacto-knife in the glove box. They did a quick search, in the interior, under the vehicle, in the box of the truck, and under the hood and gave me a quick pat down. I knew I had nothign to hide, and since all the officers were there (with guns drawn), I knew something was going on, and I complyed with everything they asked. It took about 2 minutes, and I was escorted out of the area. On my way home, (which is on a main root to the mall), I spotted about 10 more cop cars, and saw the Calgary Special Opps Excursions on thier way thier. I later foudn out it was a bank robbery. I didn't ask any questions, and Answered all of theirs, and declaired anything that may get me in any troubble, (the pocket knife, legal, blade is under 6 inches, and the exacto knife, its a foldable version). They had no warrant, and actually no real reason to search my vehicle, since there was no way the bank was connected to the parkade, but with the situation, it was probably better to cooperate then not. its all about discression.

the only way they can search your vehicle is if they have probable cause...if they have no reason then i would say no...but more than likely they are going to make u sit there until they go get a warrant...but they must have a good reason to search your vehicle.....hint.. keep your glove compartment locked and the trunk locked....if you do let them search you they must have a warrant to enter a locked compartment......but like i said...it is your right to tell them no...if u do get pulled over and a cop is harassing you...all u need to do is give him your license, registration and proof on insurance...say nothing else to him....if he ask you to get out of the car ask for a lawyer and keep your mouth shut..u also have the right to remain silent....tell the cop nothing....well hope that helps u in some way

this is a double egded sword. If you have nothing to hide why be afraid to allow a search. If you have something to hide and refuse the search, the officer may detain you, and ask the court for a warrant and then search the vehicle. so use your best judgement and good luck

I've had my car searched at drug check points and a couple times in life when pulled over. I've always given permission although I feel it to be a violation of my civil liberties and my right to privacy. You can't win on this issue; refusing permission to search may be deemed as probable cause for a warrant. I am a decent law abiding citizen who respects the police but I've had long hair and Grateful Dead stickers on my car (in Pennsylvania that's probable cause for a search), but just once, when I don't feel that respect returned, I would like to say 'no' and waste my time and theirs, but I am not that kind of person and I would just tolerate it and when they're done I'd thank God for my freedom, as I mosey on my merry way.

I always do. Not that it has happened in many years, but I've learned that you don't really want to irritate the man. Things will happen, that you won't like. You mess with them and I guarentee they will mess back, and the law is on their side. they COULD also find some contraband in the glovebox, or under the seat. Then they have you on drug charges, it may not stick, but you don't want to take the chance.
Even if you have some thing in there, let them search, if you give your permission they might not look too hard, if you delay them then they will look extra hard, and they can arrest you. Good luck

if you arent a dirty scumbag who has something to hide...yes. now if you are id still let them search you, it'll be alot easier on you and the cops. it you got a lil bit of bud on you, most cops will take it and give you a misdemenor or even less. if they have to get a warrant, they will destroy your vehicle and bring in the drug dog while you sit there and watch. now if you wanna be safe, get a lawyer on hand and get him to come down there and watch them search your car so they cant plant stuff on you or do anything else dirty.

Hell no... Well but if you come out of the car while you are being stopped for traffic violation then..they can surely ASSUME that you got ak-47 or a Street Sweeper from L.A. (They charge 100 buck a night i guess.. No offense kids)
