If I have to go back to court by him (six years past) because now he is demanding child support. One is 16 and the other 14. He makes alot of money. He is a millionaire plus with an excessive income and real estate. Would the judge rule in his favor because all of a sudden he wants it. We had a verbal agreement years ago in which he stated to me that he would never ask me for child support. I only make 7.25 and hour. Does a judge have empahty in this case?

You will most likely have to fill out a financial statement. When you do a judge will realize you can not provide this, as I'm sure they already know and why the children are living with you ex(who can provide better). Not to mention what 14 and 16 year old needs "daycare"? There are guidelines, and both parents financial situations are considered. If he has come upon some financial hardship, the court may ask you to contribute, they are your children too. Verbal agreements are nothing these days (and hard to prove at that) Most probate courts have a "lawyer of the day" that you could ask these questions to. Best of Luck!

Did you get in alimony? If not I'd ask the judge for that when he files for child support. Asking the court for custody and child support from him is also an option. Show that he obviously is more concerned with his pocket book then the children.

Absent all of that, a good lawyer will argue to the court that he has the means to take care of the children while you don't.

If he is raising the children, he can seek support. Go to your states child support enforcement site to look up your states laws and guidelines. You can compute your child support obligation using the guidelines and forms found there. He will only get what the law allows. The support will be based on both your income and his.
