If a girl is drunk, is it her fault if someone rapes her?
What about if she's dressed immodestly?

No, and no.

If a girl is drunk, someone is taking advantage of her to even try sex; if she is dressed immodestly, that is no one's business but her own.

Both issues are brought up frequently in rape trials to attempt to sway juries. Neither issue comes up very much in judge-only trials, because judges ignore such things.

It is NEVER the fault of a rape victim--male or female. No means NO. there is no blurry line, there is no "well he/she asked for it" ( unless its a role play thing and thats a whole different subject.)
If you were a victim of rape, I hope that you can be brave enough to stand up for your rights even though it will be extremely hard. Either way, please Please realize that dressing immodestly, flirting outrageously, drinking heavily--none of this gives a person the right to violate and hurt another person.
If you can't come forward or have your friend come forward then you should at the very least go to your doctor, or even a new doctor if that makes you more comfortable and get all the STD tests available. Also, look into rape victim support groups, and/or hotlines. You don't have to face this alone. You as the victim did nothing wrong.

I think too many of the answerers are so wrapped up in political correctness to give you a completely helpfull answer.
Even though the legal and moral answer to your question is no and no there is still more to it.
You are a product and/or a part of the life of your loved ones. Ones that care about your welfare and expect that YOU also take care of your welfare.
If you were to borrow the family car and get it stolen off you at gun point then, on reporting back this incident you would be held completely blame free. It's something that just happened which was totally out of your control.
However if you got drunk at a place where you or your friends could not foreseeable control what might happen, then unfortunately you must take some responsibility for occurrences despite the fact that this does not diminish the wrongdoing of others.
When the tanker hits the reef because the radar man was asleep at his post this does not completely free the skipper from any blame.

It so sad that we even have to bring it up. The answers are obviously NO. There is absolutely no excuse, I don't care how irrational someone's state of mind is, there is absolutely now way that violating a temple is fine. It there is a house with no lights on it is reasonable to believe that no ones home. If no one is home, you simple come back at a later time. To think that it is the perfect opportunity to break in an TAKE what is not yours is a criminal thought, and that is exactly what rape is. None, have the right to take without permission. Even married couples have the boundaries about the matter, how can a stranger, a friend, a family member dare to move to that level of inhuman torture.

Ladies...please watch out for one another, even if you don't like the person.

I'm a guy, and I don't go around having sex with anyone but my girlfriend, thank you.

If I was single, I wouldn't rape anyone, regardless if they're drunk or dressed immodestly.

What would be going through the guy's head? "Oh. She's drunk. Easier to rape. Ha ha ha." "Well, she shouldn't have worn that sexy outfit showing off her t&a. It's not my fault that I'm having my way with her whether she likes it or not."

Rape is rape.

A girl could be naked and drunk and it would NEVER be her fault if she was raped! NEVER EVER! alof of attacjers try to mess with the victims minds... If you are the victim I would suggest seeking help from a professional. If it was recent go to the ER . You need to get checked out for potential diesease and pregnancy.

You need to understand rape. But don't worry! about 99% of the population doesn't understand it either.

It's not about sex. Think about it, it's not possible to get "turned on" by a a crying, screaming, struggling girl. There are definate power issues.

Theres more to it than I could explain in one of these boxes, just take my word for it.

Anyways, to answer your question, it's not the same in every state, in California, guys can't even be considered for rape, due to their definition. Most of the time, if shes dressed "immodestly" the rapist will get off the hook, becuase the jury is to ignorant to know better.

When a person is drunk they are in no condition to give consent. People have used the immodest dress bit from the time history was recorded. It is a stupid thing to wear immodest clothes among a bunch of guys where the booze flows, but it certainly is no crime. However, you never know what kind of judge you might get; it depends on the part of the country you are in. I have heard mother's say "Well she is just asking for it." Morally, I would say NO to both questions. But you can't count on the law, it is very fickle.

I agree with keypoint. If both parties are too drunk to grasp reality it's both of their faults. But other than that if a guy takes advantage of a girl when she's drunk it's rape. Even if the girl says yes. If the guy knows that she's drunk he should know that she's incapable of giving a serious response.

there is no "blurry line" when it comes to rape. Any time a sexual act is committed without the consent of the other person is considered rape. With or without being drunk....No is No. And that means everyone, including woman.

The only blurry line in my opinion is where both parties are so blind drunk they can't be held responsible for what happens. If the girl wakes up later and feels bad about it I personally don't think that constitutes rape.
