Is it robbery or theft? The woman is pressing charges against her and has 8-10 witnesses that say they are willing to say that she did it. She is going to have a jury trial and faces 4-13 years. Apparently my mom and this woman were having drinks at a bar and everyone was drunk. My mom had just met this woman that night because she just moved to a new town. The woman says my mom took her purse into the bathroom and stole 35 dollars and then just left her purse in the stall. My mom of course says she didn't do it, she had her own money and took her own purse to the bathroom. Afew days later a cop showed up at my mom's job questioning her about taking the money. A week after this she was arrested and takin to jail as she was walking to her car after work. She was bailed out and is awaiting trial. What do you think about all of this? Why would the police confront her and then go back and arrest her a week later? What kind of crime is this robbery or theft?

Its petty theft but with so many willing to say they saw her she needs to find an Attorney and work out a plea deal this does not appear to be a case she can win

Under the facts you've given us, the crime is a misdemeanor theft. The potential penalties include a possible jail sentence (usually not more than 6 months) and a fine.

If the state alleges that your mom threatened the owner of the purse while committing the theft, then the charge is a robbery. That would be a felony. Possible prison sentence and a much larger fine.

It should only be petty theft and not a jail term but I wouldn't be a bit surprised if it were a scam, the witnesses of course being the womans bar buddies. I never take my purse into the bar, ever.

Petty theft. Just wondering were the witnesses the "victim's" friends if so, sounds questionable if she swears she didn;t do it. I'd check with the bar and ask if there are security cameras and request to see the footage from that night. Just a suggestion.

Petty theft. Her lawyer could argue that any witnesses were intoxicated the time, and therefore are unreliable. The accuser was also intoxicated, and therefore may have varying accounts of what happened. There could be holes or changes in her story. You need to look for those.

This would likely be a petty theft, equivalent to shoplifting. There must be other eyewitnesses or other evidence to implicate your mom. I highly doubt your mom is being arrested solely on the word of the victim, who was also intoxicated at the time of the incident.

I think it is just theft. I don't know what state you are in, but doing 4-13 is a little harsh for swiping a little money.
If there is that much time involved, i suspect that mommy isn't telling you the whole story.

If they all were drunk, and it is her word against your mothers, I don't see how she could prove she had $35.00, much less that your mom stole it, unless there were witnesses!
