It shouldn'tbe banned because it would infringe on the rights of all of the smokers. Also, If it were to be banned; people would be doing it but in secret; much like in the 20's when there was the booze ban. And most importantly for the economy. If banned, millions of people would loose jobs in manufacturing, the tobacco farmers would loose their profits, and those gas stations? many would close as well.

To answer your question, the answer is, simply put, there is no reason why smoking should not be banned. Tobacco causes more than 300 different diseases/disorders. It shortens people's lives; it impairs their health. When smokers inevitably get sick, they force non-smokers to pay for their hospital bills. It is a dirty, disgusting habit, a form of slow suicide. This is nothing new: King James knew of the problems caused by smoking more than 400 years ago! In the 1800's, it was used as an insectide. It has been used as a herbicide.
Finally, smokers do NOT have the right to smoke: read The Constitution. It is NOT in there. Simply put, if a right does not include EVERYONE (such as the right to vote) it is not a right, merely a privilege.

Why shouldn't smoking be banned? You could say that it takes away from the smoker's constitutional rights by not allowing them to do something they choose to do and it is not illegal. Also, you could say that it isn't hurting anyone else as long as they smoke alone or only around other smokers. Also, states are trying to make flame resistant cigarettes so that cigarettes can no longer cause fires.

Cigarettes and tobacco products are in most jurisdictions very heavily taxed. If you ban smoking you kill a very lucrative tax income for the gov't.
Further too many smokers are addicted so there will become an extremely large blackmarket for the illegal smokes and this inturn will cause further crime situations.
Remember illegal importation of products robs the gov't of their tax money thereby forcing them to raise other taxes or create new taxation.

Seriously, smoking helps some people deal with their emotions. Also, if smoking was banned, addicted smokers will really feel a need to smoke, and will resort to crime to get what they want. Just like with drugs.

compare banning cigs to the Prohibition. go study how the banning of alcohol led to mass crime. use the negative effects of the prohibition as an argument for not banning tobacco
