We have one child, but no possessions that we are fighting over. We have worked out an equal visitation schedule. We decided what each of us really wants out of the house. The only real debt we have is our mortgage.

Since you agree on everything, see a mediating attorney. He fills out the papers and files for you... no hastles. Costs vary $75-300 depending on state. The only way to divorce is civilly.

You can go to Family Court without a lawyer to do the child support and visitation schedule. This MUST be done in court especially if your hubby stops paying support.

You both need to decide on who is carrying health insurance for the child, who is going to claim the child at the end of the year. Some couples split this, one year the mother, one year the father.

You both have to decide about the house and if you are going to sell the house and split the profits. You are both financially responsible for the mortgage payments IF it is in both of your names.

You both can agree NOW on things but things could change. Protect yourself and your child ....

I'm sorry to hear of this, but you did the right thing by agreeing on important matters first before seeing a lawyer. Never waste time arguing at the lawyer's office. They charge by the hour. See one and tell him what you have agreed. All he needs is to file the papers with the court and sit tight until your decree nisi is granted. All the best.
