he felt that it was crap, ( the thing fell down a couple times, and in some spots it was being held up by sticks), and a hazard. Anyways, I live in California, could he sue the hell out of me if he wanted to for perhaps not wanting to replace the fence? What if he started the work without my verbal agreement? the farking guy started tearing down the fence before my father could say yes. He said he came to knock on our door a couple times but since we didnt answer, he just started anyways. I went to talk to the guy and wanted to ask him for a written agreement that he would not ask us to pay for half the costs of the fence.
He verbally agreed to my sisters and to myself and my mother that he would not charge us for the costs of the fence.
He said the neighbors were going to help him out for the fences on their sides, monetarily, but that he didnt care if we didnt pitch in for our side.

depends on who OWNS the fence, for instance, the fence around my property is MINE, it is set slightly in side of my boundary line and as such I can have it up or down and personally would not even think to ask my neighbors permission if I wish to pull it down...............
I also did not ask them to kick in for the cost period as again its on my land and my fence, so I dont really see your point, but then again as it is MY fence then I should and do keep it in good repair and painted so hopefully it will last a good while.

Again, if he took down the fence without permission and it was your fence - he's on the wrong side of the law. That being said, if he unilaterally took down a fence and then wants to replace that fence, you are under no obligation to fund his desire to have a fence - you don't have to "pay for your side of the fence." Any lawsuit he might file would fail because there is no basis in law for it. Good luck -

In my community you can do just about anything to a fence if its on "your" property because its your "fence"...if your paying "all" the expenses. Because he will be paying for it you probably won't have any say so as to which one of you is going to get to look at the best side facing in to your yard and home, sorry about that. Maybe just for your side you could at least ask him to turn the best side toward you...if it a concern to you. If not, you still get a good deal.

If he wants to put up a fence, then that is on him. If you had not agreed to contribute, you are not obligated to help pay. My neighbor put up a fence and we did not help pay for it. therefore, the fence is not a common fence (meaning he put the wood planks on his side totally, and the posts are on our side.) We asked years ago if they wanted to go halfs on a fence and they weren't ready to do it then. But recently, they needed to hurry and get one because they were having a pool built, so they built it themselves.
So if there was no agreement, he just built you a new fence. Don't sweat it. I live in Cali too.

Deffentaily get that in writing that he wouldn't sue you.
But who ever put up the fence should fix it. It's not the other person's problem. Its your property and you bought the fence.

He can't force you to pay for something he wants. If you owned the first fence, he's actually in the wrong for having torn it down.

All you can do is report him. Make SURE someone knows that this is going on so that if King bit him he wouldnt have a case in court. If you can also catch him teasing King on camera then you have more evadince. We have a big problem about neighborhood boys teasing my big dog Layla. We caught them in the act and we also told the police and the animal control and asked them to keep it on record.
