There'sa website that has my picture up on it for advertising purposes of a club. I no longer go to clubs and want the picture taken down for personal reasons. Is it legal for them to use my picture without my permission? What do I do to get it taken down? Thanks!

well this would depend . if you have been paid for the picture it's no longer yours and they can do with it as they wish . if however you have not been , then they are using your image with out your consent and not only would they be required to remove it , you can sue them for royalties and damages

First step would be to contact the club and speak with the manager and tell them that you saw your picture on their site and do not want it on there. They likely have many other pics they can use instead.

If they say no, ask them to supply you with a copy where you agreed to release your picture or likeness for promotional use and give a reasonable deadline, say, 10 business days, or demand they remove your picture from their website. There could be fine print in the prior membership agreement that allows them to use your photo or likeness for promotional purposes.

If neither of the above are met, try filing a complaint with the Better Business Bureau. Should you have to resort to getting an attorney an litigating to get the picture removed, these steps will demonstrate that you made a good faith effort to resolve the matter yourself prior to involving the Courts in the matter.

Did you ever sign a model release for that picture? If you did, then you are out of luck. If the photographer has no model release, then you can contact the club and ask them to remove it. If it has been there for some time and you have not previously complained, then you may need to get a lawyer involved. Good luck.
