my brother,sister and I have been monetarily "raped" by my aunt who has siphoned off funds before distribution...plus claimed for reimbursements that have not been substantiated by any means...yet has taken money in addition..... the final report has been done with the courts and we were all left short changed....what steps can I take to release her from her powers and get from her any actual tranactions, reciepts ect.... to access the damage (theft)?

Not what you want to hear, but you need to get a good lawyer to at minimum, substantiate whether you have a legitimate claim or not. Probate is always sticky and if your Aunt was the Executor, she may have been (or possibly, may not hve been) entitled to the funds she received as such. Only way to verify for sure is check with a qualified Probate lawyer in your State.

A Fraud claim will not be investigated if you cannot provide objective proof that it occured, and even so, it would still likely be a civil matter, not a criminal one, unless it was blatant.

file criminal fraud charges, demand a federal investigation into state sponsored criminal activities under the probate judge, seek federal indictments, and blast it out in every possible media outlet. also, file charges against the probate attorneys, and the judge with the state bar, seeking damages from them for allowing your aunt to NOT provide records of all transactions, and allowing those transaction to oiccur without court supervision. raise such a stinok, that the state itself gets involved. it will not be easy, but it can be done. get a good attorney on your side, preferably from a large firm.
