i let him have temporary custody when i moved now im back and he wont let me pick up my son we have no visitation order by a court so can he keep me from picking up my child for the weekend

First of all, if you gave the father temporary custody, you were mature enough to know and understand that at that time, he was the best parent. Now that you are back in the area, first ,try talking with him one-on-one. If you have/had serious reasons for giving your son up, you must begin to set up documentation for the courts to prove you are eligible to care for your child. Even if you were a drug addict - if you are clean and can prove it - the law would 'have' to allow you visitation, even with someone else present. Courts don't like to separate families unless serious abuse was involved. They try to work with parents and then rule on custody. I don't understand why the custodial parent would not want your son in his life. He has TWO PARENTS and should have the opportunity to know you. Again - if there are serious compliations involved (abuse, drugs, alcohol, etc.) you will have a bigger fight on your hands, but you do have the right to petition the court for visitation and possibly JOINT custody. Do NOT give that right up as his mother.

Yes, big mistake Now he'll probly get full perminant custody and good luck, this involves a lot of pain that i'm personally firmiliar with. Things of this nature are in the normal flow of lifes lessons but with a lot more pain and a lot more regretful. The worst part its not just you , not just him, the child hurts the most and matters the most, they didnt ask to be here and its unfair that there future is already being tarnished by what the parents do. either striaghten this out right away be ahead of teh game and hopefully outsmart him depending on the situation or back off and let the child be in peace, good luck Kim

Yes, without an order of visitation he doesn't have to let you see your child for five minutes, let alone a weekend. I suggest you contact your lawyer, go to court and get the vistiation order changed.

If there is no visitation order, he does not have to let you have the child for the weekend.
