my mom and my dad are going trew a divorce.He was suppose to serve my mom on april 4th but did it on April 13th. My mom just relized that she was suppose to get served on April 4th and respond by may 4th not may 13th. She still hasn't responded yet because she dosen't have a lawyer. How will this effect her case for child support.

You mother needs to get off her a** and get an attorney.

She does not need an attorney to respond. She can write a letter to the court referencing the case number and make whatever statements she wants, copy the lawyer representing your Dad. If she does not appear in court, the Judge can enter an order against her anyway.

It should be ok as long as she responds on Monday. It is kind of you to worry about your Mom and the situation that you may be in, but talk to your Mom AND Dad and let them know that you have eyes and ears and can see what is going on. Let them know that the uncertainty scares you or makes you worry and that they need to be more attentive to your needs.

Listen, is he a jerk because you know him to be or because your mother says so? I know he should pay and he's probly taking his time with it because either there could be situations between them that you dont know about, right. This is really there business and with or without your father your mother has chosen to be responsible for you. Look your not old enough to know it but working and paying bills is really hard and stressful to do with the house you live in let alone the house you live in plus somewhere else. None of this has to do with how he feels about you, he loves you and always will. I mean how do you know did he want you and your mother insisted she have you , he might think hay if you want her then you take the responsibilities that goes with it, although he should help and will again its hard, plus its the law. you'll see good luck Kim

There will be a date of service on the outer part of the packet the person who served your mother by LAW had to put the correct date of service on there, If it was mailed the post office stamp will show what date it was mailed on. All she will have to do is take that to the judge and he will have a "continuance" filed on her behalf.

Why are you worrying about this? This is really between your parents and their divorce lawyers.

Although I will say, your mother doesn't need a lawyer to go to Family Court and file for child support. This is for those living in the USA.

Your father is not a "jerk" he is your father forever. He just doesn't want to be married for whatever reason. You only get one father and one mother in life ... don't judge them.

Basically, child support is not a right, it's a responsibility. The state doesn't want to support you. They want your father to do that. Still, your mother needs an attorney, like yesterday.

It will not effect her child support, your fathers solicitor should automatically make your father aware that he has to pay this, your mum needs to get herself a solicitor,because when it comes to sorting out what your mum is entitled to, that's when shes going to need them, and who should the children stay with and what arrangement are to be made for access. It sometimes gets dirty in divorce proceedings, your mm and dad might not see eye to eye, they will be come complete strangers, and other times they could stay the best of friends. goodluck

I do not really know but i would think that it shows that she is not very reliable or dependable and she would have been a lot better of just signing it and sending it back on time for her own sake.

She needs to find a good attny, and ensure she receives proper financial support.
