that seems rather odd, usually you sign up to be part of a mystery shopper program. unless it is some kind of community consumer protection deal run by the city. Or do you work for a franchise? some times they require a mystery shop.
Why exactly are you upset about a mystery shopper? Mystery shoppers are intended to give you ideas and point out weak spots in your staff and in your business. the mystery shopper program is not public knowledge so if they reveal something damaging it would only be told to management.
my suggestion is use the mystery shopper as a way to improve your business practices, that's what they are there for.

When I was at university I did a lot of jobs that involved mystery shoppers checking up on me. And I have done a bit of mystery shopping on others too.
For those who don’t know:
A mystery shopper is a person that come into the peace you work, pretending to be a customer but is really working for your boss. While you are serving them they will grade your performance on such things as how nice you are to the them (customer) how well you know your products or services, etc and produce a report to your boss.
Now from having done mystery shopping I know that the person being mystery shopped has to be pre-informed that their job roll will require the use of mystery shoppers. However an exact time does not have to be specified.
Mystery shoppers are not allowed to write whatever they feel like (at least I wasn’t allowed) they have a strict set of targets to grade your performance and are not allowed to get very technical. Very often they have to observe your interaction with other customers before they approach you and grade you on an average performance.
If you were not informed that they may be using mystery shopper you can appeal to have the report declared ‘null and void’

I am not aware of any laws regulating mystery shopping, but there are 50 states and hundreds cities and communities that could adopt local laws to regulate this activity. Instead of relying on the advice in this forum, you should consult a local attorney for further information.

Mystery shopping is a job. A company sends you paperwork, with the where and when your supposed to shop and for what items.
The people that employ the company that employs you is usually corporate or perhaps a consumer group. Anyone is free to check another company and compare prices, quality of items and attitude of the staff any time, which is what its all about.

Of course there are no laws against people telling of their shopping experience. There is freedom of speech in the UK and any one can offer an opinion on your business.
What you should really be concerned about is giving good service so that you would be proud to be reported by a mystery shopper.

No laws at all to protect you.
In this day and age you can fully expect to get the mystery shopper visit on a regualr basis, be it a fast food restaurant, pub, off licence, where ever. Even bus drivers get a visit.
If you are doing your job properly you have nothing to fear

No most companys do this now as a way of seeing how well staff perform and to help them gage what staff training is needed
