Im in Virginia and my fiancee(18) has been in the military since she was 17 yrs and 1 month. She has paid over half of her support since she was 16 even though her mom claimed her on taxes(which she is contesting this year because her mom tried to claim her after she already claimed herself) and her dad still owes her mom back child support and signed a contract for child support but never paid any child support. her mom has never bought her clothes or bought her food since she was 14 and when she was growing up my fiancee asked why her mom didnt go to court for child support and she said because her current husband was supporting the family and she didnt want anything to do with her dad. My fiancee wants to know if she can get the back child support from her dad or only her mom can because her mom is trying to sue for back child support now and my fiancee thinks since shes been supporting herself ever since she became a teenager she should get it Is that possible?

There is a chance....can she PROVE that she was self supporting during that time? If so, she may have a case. She'd need to see an attorney--which may not be worth it. Since her father never paid her mom--it's doubtful he will pay her. She definately has a case with the IRS since mommy tried to claim her when she was no longer a dependent..that should not be hard to prove!

In my opinion..she is old enough to handle money. She needs to speak with a lawyer though, to see what they say. If however, nothing gets done until she is 18, she can try to go for the back child support herself. She needs to talk to her mom about it, and see what she says, if she has to, tell her to get a lawyer and explain the situation.
