I am curious who is ordering the drug testing and why. When I went through my divorce I couldn't force a drug test, nor could he, if there is a criminal record one parent could petition the court for a drug test and then the judge could order it, but if both parents are dirty that is a bad idea so who would do that. I suggest taking all the steps to try and get yourself clean now, rather, clean up your act now. If you stop, tie off drugs will also show in a hair test. If you are abusing drugs, sadly the best place for your children is in a drug free environment, not foster care, but perhaps a family member. If the threat of losing your children gets you to straighten up your life, it could be a good thing. Good luck to you, I know that the road youa re about to embark on is long and difficult.

Can you afford an attorney? Do you have one? The family courts usually offer clinics, it takes a while to get in to see one of hte lawyers or paralegals, but it is free and they can help you greatly. They can tell you what the best course of action is. Judges look kindly on someone who is really trying so doing what you can now is in your best interest, even if you enroll in a rehabilitation program, and free parenting classes. You have another chance, try to let go of your desperation, its hard, but it will also make it harder to quit drugs. Hold on to hope and ask around, there is free help everywhere.

No, but my husbands niece did, all 3 of her little girls. Her parents now how guardianship. Although her mother is also an addict as well. I also answered your other question as well. And I can tell you this, if this is what your going through, there is rehab, drug court, NA, and various other programs that will help you get clean if you care too. It will be a long road to recovery and at the end of it your child(ren) will be waiting for you to be a family again.
I know states very, but in mine, if the courts are involved over 18 months, your parental rights will be terminated and you will lose your children permanently. So, you do have time to get your lives together.
During this time, if a relative can meet the approval of the courts and be willing to take foster parenting classes, they can stay with family. If not, they will remain in states custody until you get them back. If you do not get them back, and your parental rights are taken away, then they can be adopted to a qualifying family.
If I am wrong in assuming this letter is about you, I do apologize. If it is your parents, I am sorry you have to go through this, but maybe now you will understand what is going on. Hope my response helps you.....

If both parents are dirty, then the children will go in the system and you are going to have allot of hoops to jump through before they give them back to you. That is what usually happens. Sometimes they do allow the children to stay in the home but they are constantly stopping by for random drug screenings. If they do how ever put the kids into the system, you can have them placed with a family member, as long as that member is clean and has a good home.
Bottom line, it is going to take AT LEAST 1 year to get the children back because of all the hoops you will have to jump through. Not only treatment for drugs, but parenting classes, possibly anger management, LOTS of random drug screenings, and family counseling as well. Good luck to whom ever has this problem.

In Nevada you have to go through Family court and follow the guide lines. One or both of you are going to jail, then your both going to family counseling and court appointed drug counseling. this can and does take up to four years, yes Honey, four years, it's hard but that's the rules there. Then, after you meet all their guide lines, you may have your children back under supervision if the sponsors that have the children think your O.K. again to raise them, they may not.
Maybe, after about five years or so, you may start out as a family again. Remember, you did it.

I would recomed to anyone in this situation to take your junkie a*s to rehab a.s.a.p before child services take away your child , and if you cant pull your head out of your a*s and get clean for your childs sake, then you dont deserve the child so maybe they will be better off in a foster home, where they are not going to have to worry about mummy selling there toys for crack or pricking them selves on a dirty needle or becoming a junkie themselves....

The children go to foster care until the parents successfully complete a treatment program. Could take one to three years.

I am in law enforcement and i deal with this everyday..When both parents are drug abusers the children are placed in foster care or they are placed with immediate family if they pass the background check and their home is suitable..

i'm not sure, but if it's really bad, the kids might be taken away and put into foster care or given to the care of family members..
