My guess is there is a BIOS setting causing it to wake up. Why don't you turn it off and unplug the network cable. If it turns on by itself again, it's not wake on LAN. Check the BIOS for scheduled start up information. If it doesn't turn on, look for wake on LAN settings in your BIOS.
By the way, this couldn't be caused by a virus or piece of spyware. The computer needs to be on for things like that to do anything.

Check when you turn it on you might have it set to restart on a power surge/outage and it could be detecting a loss of power and restarting it's self in protection

You may have some settings in the BIOS that wake the computer up, ie, modem, network card etc.

it must be in the bootup section
restart and enter setup f1 or f2
and find boot and turn off power up and save before leaving
