My girlfriend is leaving her husband. They have 3 children. She is letting him stay in the house, and leaving the children there as their primary residence so they dont have to change schools. They agreed on paperwork that they will have 50/50 shared custody and she will see them as much as she does now. Does she have to pay child support to him? Is there a law that one of the spouses has to pay child support?

50/50 custody usually means that they are going to share responsability for the children. But if one parent intends on brushing off their part onto the other that custody could be changed where she would have to pay child support. As a mother myself I have custody of my children and their father has only been current on support for one year. He never sees them and rarelly calls, My partner on the other hand shares custody of his children and agree on terms of how things should be payed for and who is responsible for what and a definite visitaion plan so everyone even the children know whats going on and when the next time they get to see there other parent. make sure everything is in writing down to the littlest detail and that should take care of things. If she doesn't plan on having the children for close to half the time their could be problems. and she might have to pay.

Usuaully in a 50/50 split the parties agree to no child support because it is a bit redundant. When she has the children he pays her when he has them she pays him. All that they really need to clear up is that she will be able to claim them on her taxes for half the year and he will claim them on his for half the year.

NCP pays child support depending on the worksheet/info provided to the courts. Check your state laws. It is based on income and calculated by a formula when both (divorced)parents income is combined

The parent whom the kids are not living with full-time has to pay child support.

no... women dont have to pay child support.. im not sure about the laws in different states, if the kids were awarded by the court, but i never heard of that a woman pays a man...
if the man was a MAN... THIS WOULD NOT BE HAPPENING!!!
income is the thing... my x is disabled vet... i was the bread winner, but kept custody... i was awarded 25 week... 10 years ago... never seen a dime...unbelievable~!!!

It depends on what state you are in. In the county I live in who ever has the children at night is intitled to child support.

You pay, pay and pay til your kids get 18 or you die. Either you pay or go to jail and lose every license that you would be elegible for driving, fishing, hunting, etc.

as for kim t women/the MOMS DO pay child support! duh there r shity mothers out there just as there are fathers. my step kids mother pays HIM $118 a week and she takes them one day a week!
its up to the courts to decide who gets what
