It depends on what you mean by "unpunished." They have to be reined in as much as possible--simply to minimize the damage they are doing.
Beyond that: there's no question that both of them deserve to be impeached, and convicted. And--it may yet come to that. But only as a last resort.
My concern is the good of the country--what happens to them is a minor matter by comparision. And at this point, if they can be reined in, its probably best to let them serve out their terms and then drop it. I believe it would cause more harm to bring them up on charges (again, except as alast resort) because this would inevitably be politicized. And we do NOT need to set a precedent of forcing a sitting cheif executive out of office for political reasons.
That's the reason John Ross sacrificed his own political career stopping the impeachment of Andrew Johnson 140years ago. And the neo-con assult on the presidency in the 90s is another good example. By comparisiion, the forced resignation of Nixon provides an example of the fact that a proven case should not be passed over lightly--there can be times action at the extreme has to be taken.
But in all three cases, when it came down to it, lawmakers have acted responsibly--meaning the majority put the country first, and that is aas it should be.
Does that mean probably letting Bush and Cheney go scot-free. Yes. If that's best for the country. Let history and God judge them.

the worst thing that could happen is for you leftists to throw a hissy fit and shut the government down like you did briefly in the 90's, the best thing that can happen is for the Dim party to disappear, at least in it's current incarnation

People could keep whining about how he 'got away with' something, leading to more conspiracy theories, and generally wasting bandwidth.
But that's a worst-case scenario, I'm pretty sure conspiracy theories are already at the saturation point.
