My son was killed in an auto accident and as soon as I went back to work I was laid off. Now my car has been repoed with all my belongings still in it. (including flowers for my sons grave) I am getting the run around and they wont let me get my stuff how long can they keep it? My husband also had all his tools in the car that he needs for work.

You are entitled to the return of any pesonal property that is not actually a part of the car. If you have tools, clothing, etc., that should be returned to you.

However, if you had installed a custom stereo set in the car, that becomes a part of the car and is not subject to return.

My outlook on this matter is based on Pennsylvania law.

Talk to a lawyer about a possible replevin action.

well, here is the legal issue clarified - the vehicle was repossessed on the finance company's volition since thew are the legal owner of it. cost of storage, towing aso. will be resolved once the car has been resold and the proceeds deducted towards the loan amount.
as to the contents - you are the owner. go to the impound lot and ask to have collect personal property.
if there is a problem go to the police department and ask for assistance - it strikes me that the last thing you need right now is attorney fees.

I am so sorry abut the loss of your son that is such a terrible thing to have happened. I'm also sorry for all that your going through.

It may be possible for them to keep the things, you may need
to check with a lawyer.

It is state law.

Around here they hold them, but they charge a fee for removal and then a daily storage fee-find out fast.

They are required to tell you the policy if you ask. If you dont like what they say then call the finance company-also required to inform you. If that differs or you dont like it then call a lawyer and explain everything-some will give free advice.

Yes, I believe they can. To add insult to injury they can offer to "sell" them back to you under their "storage" fee rate. Try speaking with the finance company to clarify this. So sorry about your loss.

By federal law they have 48 hours to allow you to retrieve your things. They can not hold them or it would be considered theft.
