Technically, it could be.
Depends on the exact wording of the law and if it makes any distinction between smokers and non smokers.

But I would not try and use it at any time. You would get laught out of court.

Are you kidding? It is pathetic for smokers to complain of the effects of passive smoking! Maybe, if not obviously, they are affected by their own smoke!
