I have cancer. My employer is stalling having me go to Court because of their many violations againts the Americans with Disabilities Act(ADA). I have stage 4 colorectal cancer. My employer is with holding vital evidence. They don't want to settle because I'll probably die before this goes to trial.
How do I proceed with this matter?

As unfortunate as it sounds, I've seen this many times before. Get with your attorney and see about recording a video testimony so that in the event that you do pass away before a trial, your voice can still be heard. Also be sure that all evidence you have available to you is well organized and easily accessed.

Good luck.

Don't expect to see this in court in your lifetime.

The SOB's can and will drag things out for months or even years.

Record all your testimony on video tame, under oath. If you can speak to the jury from beyond the grave, as it were, it might be highly effective.

And make sure that your family knows what your wishes are in the case. Let them settle or drive for principle just as if you were there guiding the case in person.

Good Luck and God Bless you. I hope you really nail the bastards.

I thought there was something that could be asked for like a "speedy trial" . Your lawyer should be able to ask for this, they probably will be getting a percentage of what you get right? Complain to the courts daily they will get sick of hearing from you at some point and will want to get your trial done..Sorry to hear about your illness, good luck!

it is not just about you and your boss, so thank you for asking the question. We should fight against so severe people. Oh, I'm not sure if he belongs to people at all. I'm sorry you will leave this world, but if you want to do something for all of us staying here, then try to record his words and to collect material and all the evidences that could compromise him. Please, inform all institutions that could be interested in the matter...try to make it publicly. If you don't put him to the court, you will at least show which class of person he is. Please do it...you, unfortunately do not have what to lose. Congratulations!

I'd take it to the media, then lets see how fast things get moving. Stupid jerks!! The news media have such a way of making things break loose, since people end up looking so stupid for what and how they are behaving.

God Bless you.

Your estate can still sue them on your behalf. You obviously won't get any benefit personally, but whoever you name in your will is going to. Have your lawyer explain to them that it's going to look even worse after death - so they should settle now and save face while they can.

You obviously have a lawyer or a union representing you. Ask there, not a lot of people , who, whilst well meaning, can only guess.
