Tree fell on my neighbors house. Do I have to remove it from their home?
My tree fell and is resting on mine and my neighbors house (very big tree). If I have a tree service remove it do they have to remove it from my neighbors home too? What if they cause further damage to my neighbors home am I liable?

yes, you have to have it removed from all locations where it fell and you have to pay for damages to the other person's property, its your tree. If it was their tree you would expect them to pay.

In general, you and your tree service are liable for any damage to your neighbor's house. If your tree guy is licensed and insured (or bonded) he is typically liable to you for any damage to your home (also depending on the contract you had with him, and the state your in). Alot of it will depend on whether the tree gut acted reasonably, or negligently as an average tree guy under similar circumstances. You should talk to an attorney quickly (the first 1/2 hour of consultation is usually free).

Does a bear poop in the woods? Remove your tree from your neighbor's house. You are both morally and LEGALLY obligated to do so. Your homeowner's insurance will almost certainly pay for it. File a claim with them. As for the contractor who does the job for you, they also should have insurance which will be liable if they do any additional damage to your neighbor's house

Yes, you are responsible for the removal of the tree. Talk to your neighbor and discuss it before the tree cutters arrive. Tree cutters are very knowledgeable about avoiding that sort of damage however. Talk talk talk, to you neighbor and the tree people. It's always better to keep the lines of communication open. If you end up in civil court, it's always goes better for the accused to be able to say that you discussed it and tried to work things out to avoid civil court. Judges love people who do that.

I would consult with your neighbor first. However, I would have to believe that you are legally obligated to either remove the tree or pay for its removal and any damages caused during the removal process. So, in the end, it really doesn't matter.

Yes you are liable. It was your tree that cause the damage. Your home owners insurance should cover the cost. Call your agent.

No, the neighbor can have it removed and their Insurer will recover the cost from you.....together with the cost to repair the damages.
The public liability coverage on your house insurance will settle with them.

I'm hoping you have liability insurance.

yes. the fire dept won't, but you may not be responsible for the neighbor. check town rules and his insurance
