It depends alot on the time of day or night, if it's after 10 pm it is in his favor if the noise is before 10 pm maybe not. It depends on the noise, you said you were crying on one occasion, that shouldn't be a crime, unless you were throwing a tantrum and breaking dishes. If the walls are that thin in your building maybe you should move to a safer location. Good luck, we live in America, you should be able to make some noise when you fell like it, these other jerks need to get a life.

So you can counter-sue , just go down to the court and bring ALL your proof of your innocence .
