My mom got a parking ticket mailed to her...and she was no where near the city where it says the ticket was issued. What sort of recourse does she have to fight it?

I'm sure the DPT person put a ticket on whichever car got the ticket, but the one in the mail came to my mom. I ran the plate number on the ticket (I work for a private investigator) and it's her car. I think that there must be a digit off on the one the DPT person wrote....I just need to know how she can fight it, and prove she wasn't anywhere near where it happened. I could always ask my police chief buddy, but I wanted to try here, first. :D

how much is the penalty on the ticket? she could just pay it to make things simpler. If not, she will have to go to court and tell her story and hope the judge buys it. does she have any documents that prove she was elsewhere, like a store receipt for something she bought? (those list the time of day usually)

Um, while I suppose it is possible that when the officer ran the plates he or she could have punched in an incorrect plate number - but, in addition to the plate number, the traffic cop or meter maid would be trained to double check the plates with the make, model and VIN of the vehicle before issuing the ticket. Check the parking ticket - if it has the VIN number on it, then it was your mother's car. Sounds like your mom was somewhere she doesn't want to admit to being. The other possibility is that your mom sold her car and the person to whom she sold it has not yet transferred title?

If your mother was not there you may have a case as long as the vehicles she owns were not as well. IF neither or those is the case, then she needs to contact the city and ask them to provide a copy of the ticket with all the vehicle information. She could then provide a copy of DMV records showing all vehicles owned as well as witness affidavits for her where abouts at that time and she would have proved her case.

Either way, she must attend the court date and preferably with all that infomation, or she will need to ask for a continuance.

She needs to take it to the police station nearest where it was issued and talk to them about it. On the ticket somewhere it should say the license plate, does it match? Is there any identifying info on the ticket like color of the car, time ect? The fact they would mail it to her seems strange, why wasn't it left on the car when it was parked? I would definitely chew butt out for that one.

Write the city, say it wasn't her. The meter maid may have written down the license plate wrong.

you can bring it to the police station from wher it was issued and have them fix it
